1. Agreement

By using the Moanv website and services, you agree to these Terms of Use. If you do not agree, please do not use our services.

2. Who we are

We build websites and business software for small businesses and trades, and we work out of Perth, Scotland.

3. Use of our services

You may use our website and services for lawful purposes only. You must not misuse our services, attempt to gain unauthorised access, or interfere with the operation of our systems.

4. Waitlist and beta access

Joining our waitlist does not guarantee access to our products. We may invite users to beta programmes at our discretion. Beta products may be incomplete and subject to change.

5. Outdoor activities disclaimer

Our tools (including Highland Hike Planner) provide information for planning outdoor activities. You are responsible for your own safety. Weather, terrain, and conditions can change. Always check local conditions, follow official guidance, and use your own judgement before undertaking any hike or outdoor activity.

6. Prices and paying us

Our prices are published on our pricing page. The price we quote you in writing is the price you pay for the work agreed. If you later want something that was not agreed, we will quote for it separately before doing it.

You can pay in one of two ways:

Monthly, with nothing up front. You pay a fixed amount each month by Direct Debit, with a minimum of six months. After that it simply continues month to month until you tell us to stop. This is a subscription for building and running your website — it is not a loan or a credit agreement, and you are not buying the site in instalments.

In full, up front. You pay once, and hosting, updates and backups are then charged monthly at the care plan rate shown on our pricing page.

7. Direct Debit

Monthly payments are collected by Direct Debit through GoCardless. You set this up once using a link we send you, and you are protected by the Direct Debit Guarantee.

Your first payment is usually taken a few working days after you set up the Direct Debit, and monthly from then on. We will tell you the date before we take anything.

If a payment fails, we will let you know and try again. If payment is more than 14 days late and you have not been in touch, we may pause work and take your site offline until the account is up to date. We will always contact you before doing so.

8. What happens after the first six months

Nothing changes and nothing is renewed. Your plan carries on at the same price, month to month, for as long as you want it. We will not raise the price without telling you at least one month beforehand, and we will never move you onto a different plan without asking.

9. Cancelling

Before your site goes live. You may cancel at any time. We will invoice you for the work done up to that point and nothing further.

In the first six months. The monthly price assumes a minimum of six months, because that is roughly what it costs us to build the site. If you need to stop sooner, talk to us — if you are leaving because we have not done a good job, we will not hold you to it.

After six months, or on the care plan. One month's notice, in writing or by email. We take that month's payment and that is the end of it — no exit fee, and we will not chase you for anything further.

You can cancel your Direct Debit with your bank at any time. Doing so does not by itself cancel your agreement with us, so please tell us as well.

10. What you keep if you leave

Your domain is yours. It is registered in your name, not ours, and you take it with you. We will help you move it at no charge.

Your content is yours. Your text, photos, logo and customer details belong to you and always did.

The website files. Once you have paid in full — the one-off price — the site is yours and we will hand over the files. On a monthly plan you are renting the site rather than buying it, so if you stop paying, hosting stops and the site comes down. Ask us and we will hand over your content and photos either way.

11. VAT

We are registered for VAT (GB497414749). Every price we publish is in pounds sterling and includes VAT — the figure you see on our pricing page is the figure you pay. Your invoice will show the net amount and the VAT separately, so you can reclaim it if you are VAT registered yourself.

12. Intellectual property

All content, branding, and materials on our website and in our products are owned by Moanv Limited or our licensors. You may not copy, modify, or distribute our content without permission.

13. Limitation of liability

To the fullest extent permitted by law, Moanv Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our liability is limited to the amount you have paid us, if any.

14. Changes

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
